The MM2H Property Requirement, and Why It Is Not Optional

Do you have to buy property on MM2H?

Every MM2H tier requires a property purchase, and the pass is revoked if you fail to buy or if you sell within ten years other than to upgrade. The federal floor is RM 600,000 at Silver and RM 1,000,000 at Gold, but the state sets its own minimum, and the higher figure applies. The purchase is not a permitted use of capital. It is a condition of holding the pass.

How the rule works

You apply, you are approved, and then you buy. The purchase is completed after approval, within the period the approval specifies.

The property must meet the floor for your tier. At Silver that is RM 600,000. At Gold, RM 1,000,000. Above those, each state applies a foreign buyer minimum, and the state figure governs. A RM 700,000 unit that satisfies Silver federally can still fail a state floor of RM 1,000,000, which is the trap behind half the agent marketing in Johor and Penang.

Selling within ten years revokes the pass, unless the sale is an upgrade to a more expensive property. That exception is narrow and needs to be documented before the sale, not after.

What this does to the money

A deposit is liquid. A condo in a foreign market is not. The programme converts USD 150,000 of savings into an illiquid asset in a specific price band, in a market the applicant often has never lived in, with a ten year exit restriction.

Three consequences follow.

The resale pool is thin. Foreign buyer floors push the whole segment upward, and the buyers you will eventually sell to face the same floors. Liquidity is worse at RM 600,000 to RM 1,000,000 than at either end of the market.

The holding period is enforced. A change of plan in year three, whether health, family or work, does not release the capital.

The rental yield rarely covers the cost of holding. Service charges, assessment tax and management fees are recurring, and a vacant unit in a resort market can run at a loss for years.

The state layer

Malaysia runs MM2H federally, but property minimums are state matters. Johor, Penang, Kuala Lumpur and Selangor each set foreign purchase floors, and they change. Sarawak and Sabah run their own long-stay schemes entirely, with their own conditions and, in Sabah, a fixed high-rise floor price.

An applicant comparing federal tiers is therefore comparing only half the rule. The other half is where the purchase actually happens.

Who this suits

Someone who intended to buy Malaysian property anyway, at or above the floor, in the state where they plan to live, and who is comfortable holding for a decade.

Who it does not suit

Anyone treating MM2H as a retirement visa with a refundable deposit attached. The deposit is refundable. The property is not, at least not on your timetable.

Anyone who wants to rent first and decide later, which the programme does not permit at any tier.

Watchpoints

  1. Purchase is compulsory, not an option to buy. Failure to buy revokes the pass.
  2. The state floor can exceed the federal floor. Check both before making an offer.
  3. Selling within ten years revokes the pass, unless it is a documented upgrade.
  4. The resale market in the mandated band is thin. Assume a slow exit.
  5. Holding costs are recurring. Service charge, assessment and management fees do not stop.
  6. Sarawak and Sabah have separate schemes and separate rules. Federal MM2H does not cover them.
