Overseas Citizen of India (OCI) Card

A lifelong, multiple-entry registration for foreign nationals of Indian origin and for foreign spouses of Indian citizens or OCI holders.

This is the only status in India a foreigner can hold without an employer, a sponsor or a 180 day exit cycle. That makes it the answer to most questions about retiring in India, and it is why the name misleads. “Overseas citizen” is a marketing phrase. The statute creates a registered foreign national with defined rights and a longer list of exclusions, and confers neither citizenship nor a vote.

Application flow

  1. Identify the eligibility limb you are claiming: former citizen, descendant, minor child, or spouse.
  2. Assemble ancestry or marriage evidence. Old Indian passports, birth certificates and school records carry the weight, and a broken document chain is the usual reason an application stalls.
  3. Apply online at ociservices.gov.in and pay the fee.
  4. Submit the file at the Indian mission with jurisdiction over you, or at an FRRO if you already hold another status.
  5. Wait. Three to six months is normal and there is no published expedited track.
  6. Register the card against each new passport within 90 days.

Good fit

A person born in India who took another citizenship and wants to return without a visa cycle. The child or grandchild of Indian citizens who can document the line. The foreign spouse of an Indian citizen, married two years, who intends to live there rather than visit.

Poor fit

Everyone with no Indian ancestry and no marriage to an Indian citizen or OCI holder. There is no investment, talent or retirement version of this card, and no amount of money changes that. Also a poor fit for someone who needs to vote, stand for office or take a government job, because those are precisely what OCI withholds.

Watchpoints

  1. OCI is not citizenship. Holders cannot vote, sit in Parliament or a state legislature, hold constitutional posts or take government employment.
  2. Property is restricted. Residential and commercial property are allowed. Agricultural land, farmhouses and plantations are not.
  3. Some activities need separate permission. Research, missionary work, mountaineering, journalism and work for foreign missions are not covered.
  4. You cannot apply inside India on a Tourist, Missionary or Mountaineering visa. People who arrive on the wrong visa leave and start again.
  5. Exclusions are absolute. Former citizens of Pakistan or Bangladesh, and their children and grandchildren, are barred. Serving or retired foreign military and police are not registered.
  6. The passport update rule is enforced. An unregistered new passport causes problems at check-in and at immigration.
  7. The citizenship clock is theoretical. The statutory route exists, but grants are discretionary and rare.
